also the barry bonds trial continues. another famous slugger will take the stand today. it's all ahead on the ktvu morning news. good morning. welcome to a brand new day. tuesday march 29th. i'm dave clark. >> good morning. i'm pam cook. let's get weather and traffic starting with steve paulson. pretty nice out there, steve. very nice there, pam and dave, good morning. we have higher clouds up above. that's really the only thing stopping us from warming too much. we will see slightly warmer temps. 60 pacifica to 70 antioch. morgan hill 68 san jose. mid-60s in between. if you're looking for really warm weather, you might like our five-day forecast. we'll get to that in five minutes. now at 5:00 here's sal. steve, right now traffic is moving okay here on interstate 880 northbound. but southbound 880 at 238 we have a couple lanes closed on the ramp because of a big rig accident. they're still trying to clear

it. chp has issued a sig alert. commute okay on the san mateo bridge heading to the high- rise. now back to the desk. we begin in hercules this morning where a landslide is threatening homes. ktvu channel 2 reporter kraig debro joins us now with what's being done to help these homeowners. good morning, kraig. >> reporter: yeah. this morning the dell young that forced the red tagging little signs of slowing down. take a look at the gutter here. this is water runoff from the hillside. it's not raining tremendous amount of water t. is one of the red tagged homes. it's so bad take a look at that. there's actually water coming out from underneath the garage door of one of the homes. now crews are due out this morning to construct barricades in the back of some of the homes. they say red tagged four homes last week. the problem is sliding hillsides above the homes. according to a published report the earth has already slid into one home and broken windows.

the barricades are supposed to protect homes from further movement. just yesterday the city red tagged -- excuse me yellow tagged four more homes. they were yellow tagged meaning the owners can't enter and leave to retrieve property but aren't supposed to spend the night. utilities have been disconnected in the red tagged homes. tonight the city council will meet tonight to decide whether or not to declare emergency. see when these crews are due up here today. reporting live in hercules, kraig debro, ktvu channel 2 news. now so some overnight news where right now oakland police are searching for suspects in a drive by shooting. show you new video of the victim arriving at the hospital. he was shot three times on ninth street at about 12:45 this morning. police have not yet released any details about the vehicle that was seen leaving from that scene. also in oakland overnight fire and sparks on a power pole forced the highway patrol to shut down the 23rd avenue

offramp from interstate 880. that happened just before 1:00 this morning. oakland fire also responded to the scene to put out that fire. and the 23rd avenue off ramp is now back open this morning. four people though are without power because of that fire. pg&e crews in san francisco have pulled an all nighter. we shot this video about 30 minutes ago. workers are still repairing a faulty electrical cable that caused an explosion in a busy union square shopping district yesterday morning. the blast sent a manhole cover flying 15 feet into the air, but fortunately no one was hurt. time is now 5:03. in the barry bonds perjury trial a man with a name very- known to bay area baseball fan asks due to testify this morning. ktvu's allie rasmus is live outside the federal courthouse in san francisco to tell us who it is. good morning, allie. >> reporter: good morning,

dave. prosecutors plan to call jeremy john mccain jam by. his older brother also expected to testify. they're not expected to talk specifically about barry bonds or anything they may have or may have not seen him do. instead the two brothers are expected to talk about their working relationship with greg anderson. anderson was bonds' trainer and is the man accused of giving bonds steroids. now both brothers have said in the past they sought out anderson specifically because of bonds' success. so the message prosecutors are trying to send to the jury with the testimony today is that bonds had to know the stuff he was taking from anderson contained steroids because other baseball players knew about it. bonds is on trial because he's accused of lying about his steroid use. bonds is expected to be back in the courtroom again this morning just like he has every single day of the trial that started last monday. he usually arrives around 8:00 and things get started around here in the courtroom at 8:30.

lye in san francisco, allie rasmus, ktvu channel 2 news. >> and you can get updates on the barry bonds case any time by going to our channel 2 website at ktvu.com. just go to the home page. also today the u.s. supreme court finally takes up the case of a bay area woman who accuses wal-mart of discrimination t. is a battle that's raged on for ten years. arguments in the sex discrimination lawsuit begin today with debate focusing on whether it should become a class action lawsuit. a woman from concord is one of the six plaintiffs in the case. if the board gives the case class action status, the lawsuit can then involve as many as 1.5 million people. we're going to bring you a live report on this lawsuit coming up at 5:45. the city of san francisco could become the first city in the whole nation today to take away those phone books you get on your doorstep. the board of supervisors will vote this afternoon on legislation restricting phone

book deliveries. residents will only get a phone book if they personally ask for one. supporters say that would protect the environment. however some business leaders claim that decision will hurt companies who advertise in the phone books. police in antioch believe a middle school art teacher has now fled to mexico to avoid arrest. officers were looking into allegations that the 63-year- old had inappropriately touched one of his students at park middle school and also accused of making lewd comments to the eighth grade boy. police say he vanished last week shortly after officers interviewed him. the attorney general's office is urging state regulators to toughen the $3 million settlement it reached with pg&e. california public utilities commission held a hearing yesterday to determine if the utility should be held in contempt for failing to provide all of its documents about pipeline safety after the san bruno explosion. the attorney general's office

says $3 million is not enough and the deal does not give the cpuc enough oversight. pg&e executives say they've collected thousands of documents describing the pipes and they're looking for more. time now 5:06. firefighters in san carlos are offering to take a 10% pay cut to help the city deal with its budget problems. city officials recently voted to stop sharing fighter services with nearby belmont after 30 years. they say it's just too expensest pensive. now they're considering contracting with redwood city or forming a stand alone department. a judge now siding with the city of oakland in a very complicated legal dispute. this involves police and the city's public safety parcel tax. a woman in oakland pursued the city over measure y back in 2008. she claimed the city illegally collected partial taxes. even though police staffing has slunk below the requirement spelled out in measure y. however a judge tentively ruled

that the city has done everything possible to fix that problem. catching muni's j church line in san francisco could soon be a lot easier. the examiner reports that transit agency director is considering having trains on the light rail lines start arriving at their stops every ten minutes. right now it takes the trains anywhere between seven to twelve minutes. the change would make the schedule less confusing. the muni board of supervisors has the final word on whether to make that adjustment. cal train is making some strides in trying to bridge a projected budget deficit of $30 million. right now cal train is in negotiations with the santa clara valley transportation authority for an infusion of $4.9 million over two years. currently projected to run out of cash by 2015. as a result cal train has said it may need to cut the weekly number of trains of 86 down to 48. also they're thinking of eliminating weekend trains and

closing up to seven stations. time now 5:08. you're putting sal to work early. >> of course. >> very early to get everybody to where they need to go. >> that's right. we have a problem already to talk about. southbound 880 on the connector ramp to 238. we have a couple lanes closed because of an earlier crash where a big rig hit the wall. one lane is getting through. and for this time of the morning it's okay, but if the closure stays for much longer we might have a problem here because of an earlier crash. it is a sig alert which means supervisors think it's going to be there for a bit southbound 880 connector to 238. out to the east shore freeway westbound traffic looks okay from the richmond to berkeley area. light so far getting into san francisco from the toll area. let's go to steve. we have a few high clouds.

that's it. therein lies the rough. otherwise on the mild side. tomorrow is when sunshine takes over. warmer with 70s and thursday possibility of record highs. upper 7 0z maybe low 80s as we get an offshore breeze. heading to the coliseum tonight looks good to me. 7:05 mostly clear. breezy outside the stadium or if you're in the higher decks, but down on the field or near lower bowl looks pretty nice 56 degrees. temperatures won't be an issue. in fact it will be all right. oakland start at 57, 54 at noon and a high of 64 today. temperatures again up a couple degrees. we have some higher clouds over us. you can see a band not a big deal but they're there. it's after tomorrow that they'll start to dissipate. just spilling down from the northwest. it is producing rain on the north coast but not for us. low 40s, mid-40s to a few upper 40s. san francisco 49. liver more 44. 46 san jose. napa 41 if it wasn't for the

clouds santa rosa cooler than that. mid-30s yesterday. that's not the case today. you really get a good signature right there that's the ridge that will build in behind that system going into the pacific northwest right now. so warmer weather slowly inching in. but by tomorrow it will really kick in. that means temperatures wednesday and thursday head up, upper 70s to low 80s. high clouds today, mild temps, still not too bad little warmer. more clouds for the north bay than south bay. end up low to mid-60s coast and bay and upper 60s to near 70 working your way inland and same said for livermore, pleasanton, morgan hill, gill roy. sun any vale in there. santa cruz 66. half-moon bay 62. that should say mostly sunny. that rain is not arriving. maybe that's just held over from last week to make me -- [ laughter ] mild to warm, temperatures warm up especially wednesday and thursday. it will be cooler into the weekend.

all right, steve. time now 5:11. tonight san jose city council will consider tighter leash laws. requires dog leashes no longer than six feet on city paths and sidewalks. that's 15 feet shorter than what it is right now. repeat offenders could be fined up to $200. now this leash proposal came after a deadly accident two years ago where a woman died 62- year-old beverly fell and hit her head after getting tangled up in a leash held by a man riding a bike. we're learning more details about who was on board that sailboat that capsized in san diego. what authorities are now investigating as a possible cause of that deadly accident. also this morning in london secretary of state hillary clinton met with the representatives of the libyan rebels fighting gadafi's regime. the exit strategy for gadafi that's being talked about by world leaders in london right now. good morning. highway 4 traffic looks pretty good getting up to the willow

welcome back. our time is now 5:14. right now world leaders are meeting in london. they're making plans for what's next for libya. secretary of state hillary clinton is there as well. ktvu's scott mcfar land is in our washington d.c. newsroom with how all of this is playing out on capitol hill.

scott. >> reporter: nato has taken over military leadership of this military action in libya. and the world leaders you referenced meeting in london are talking about the transition. secretary of state clinton arriving there this morning also talking about how to strengthen the no-fly zone over libya. in his speech last night future decisions about air strikes also would be made by nato. washington later today though dave as you mentioned we do expect a battle over what the president has laid out a strong plan. >> there is no question that libya and the world would be better off with gadafi out of power. i along with many other world leaders have embraced that goal. and will actively pursue it through nonmilitary means. >> if we tell gadafi don't worry, you're not going to be removed by force, i think that's very encouraging to gadafi. >> reporter: also in those meetings in london, leaders of the rebel forces in libya to talk about what to do politically, what to do for

leadership if gadafi does choose to flee. live this morning, scott mcfarland, ktvu channel 2 news. in japan today the situation at the nuclear power plant is being called grave after confirming that highly toxic plutonium is seeping from the plant. plutonium was detected in soil samples near the plant. and operators say the amount of plutonium in the soil is not a risk to humans, but they also say the discovery is another indication that radioactive water is leaking from the plant. time now 5:17. authorities in san diego want to know if a capsized sailboat where two passengers died was overloaded. a 73-year-old man and his 48- year-old son both died when the boat you see at the top right of your screen it flipped over in san diego bay sunday. a group that provides sailing trips for people with disabilities organize the outing. two disabled young adults and six other people had to be rescued from the waters.

this morning police in antioch are looking for the driver of a stolen car who ran away after crashing into a center divider. the crash happened last night near lone tree way and canada road. police arrested the female passenger of the car but they say the man driving fled the scene. the car they were driving had been stolen earlier in the day. 5:17 is the time. there's some overnight problems, but it seems like most of them cleared up, sal. yeah. there is one that has not, pam. and that would be southbound 880 connector ramp to 238. we keep watching that for you. it is truck crash. now there's one lane open and two lanes are closed. they're cleaning up a truck that ran into a sound wall there. now it's early. so we don't have a big back up. but we're going to be watching that and chp has issued a sig alert. we have no idea when that's going to be open again. this is a look at 880 north and southbound near the coliseum and traffic looks well. of course south bay right now a nice drive into the valley as you look at a live picture of

northbound 280 approaching the 880 interchange. at 5:18. let's go to steve. sal, mostly fair, but higher clouds drifting over. rain being reported crescent city and down to eureka. tail end of this system is bringing a few high clouds. still be slightly warmer. tomorrow that's when we go sunny side up and warmer with mid to upper 70s. and thursday possible record highs. yes, yes. it will be warmer. breezy. but that will be an offshore breeze and upper 70s and low 80s heading to the coliseum tonight mostly clear, pretty nice. temperatures starting off maybe upper 50s to mid-50s. but by the end of the game down in the low 50s. oakland today looking for mostly sunny skies. few high clouds will continue to drift by. 47 at 7:00 a.m. 54 at noon. go to high today in downtown oakland of 64 degreesful right there you can see the higher clouds just filtering through keeping the north bay and many other locations from getting cooler. yesterday a lot of 37s. they're in the 40s due to the cloud cover. you can see the little just tail end of that system giving

some light rain up. but for us end result will be higher clouds. low 40s, mid-40s to upper 40s. san francisco 49. 46 concord. 44 livermore. san jose at 46. livermore forecast today under mostly sunny partly cloudy skies but mostly sunny. a lot of high clouds. start with 42 and go 60. then a high today of 68 degrees. after this system right there goes through i mean you can see that's the tail end of it. the next part, good signature of the high building in. a lot going on out there but it's taking dead aim towards seattle, vancouver and out of our area and in fact probably out of california. today slightly warmer and then crank it up on wednesday and thursday as we mentioned possibility of some record highs which are upper 70s or very low 80s. we'll be close. north bay gets a few more clouds probably than anyone else. and a lot of clouds just drift on by. 60 to 70. 68 napa. pittsburgh pretty close as well. oakly to morgan hill, san

martin in there all upper 60s. peninsula mid to upper 60s. san mateo 66. santa cruz at 66 degrees. sunny and warmer weather wednesday and thursday. mostly about the same on friday. and a system does come by we'll see more of a westerly breeze. cooler with some partly cloudy skies until we get into the weekend. overnight the price of crude oil dipped below $104 a barrel. oil prices are coming off a two year high of $106 as rebels in libya are making gains. they've retaken some key oil ports but fighting is expected to become more fierce as rebels approach the capitol city of tripoli. that could cause oil prices to spike again. seeing how everything is effecting wall street this morning, pretty quiet yesterday as you can see with the dow, nasdaq and s&p 500 all posting slight gains. checking in on numbers right now looks like slightly low

tore flat opening this morning. we'll get a better indication as we get closer to that opening bell. now, keep an eye on hurt stock when the market opens this morning. the car rental company reports its three largers shareholders, two private equity firms and bank of america merrill lynch are selling 50 million shares to gold man sax. that came yesterday after the closing bell. the stock will open down about 5%. all right. time now 5:22. time magazine named several politicians who excel at a new skill. and san francisco congresswoman nancy pelosi makes the top ten. also why many oakland police officers are ready to find a new job in another city. good morning. traffic is moving well on the san mateo bridge, but nearby there is a ramp that's closed partially because of a big rig accident.

good morning. few high clouds around. lows are in the 40s. low, mid to a few upper. end up with high clouds but sun, clouds and temperatures continue their upward trend today. low to mid-60s and a few upper 60s and few low 70s. oakland police chief scheduled a news conference for 11:00 this morning. the chief is expected to publicly respond to the growing number of complaints of low morale in its department.

some veterans officers say it's now hit rock bottom. the police union blames several factors including layoffs, retirements and defection. >> i would not be surprised if we had 50 to 100 police officers thinking of leaving laterally to other agencies. >> now the union says oakland police are overworked and understaffed and get little support from city hall. the mayor's office tells us here at ktvu that the city is currently in labor negotiations with the police union and commenting on staffing issues would be inappropriate. your time now 5:26. house minority leader nancy pelosi made the time magazine list of top tweeters. yes, nancy pelosi who represents san francisco made the list along with senate majority leader harry reed and republican senator john mccain as well as mccain's former running mate sarah palin. a lesser known name nationally

on that list is newark, new jersey, mayor cory booker. he was on twitter saying he was "ready with a shovel" to help dig out constituents trapped in a snowstorm. a super model will be appearing in san francisco this morning. miss taylor will be at justin her man plaza at 10:30. part of reader digest we hear you america tour. passing out checks to give financial help to cities hit hard by the economy. now she will present a check for $1,000 to san francisco mayor ed lee. time now 5:27. that string of powerful spring storms is really taking a terrible toll on communities devastating floods and mud slides that led to an emergency meeting tonight. also a warning for san jose sharks fans why the team has found itself in the middle of a gang war.

the forecast. thank you. we have a lot of high clouds over us. lows in the 40s. low, mid to upper. end up with partly sunny skies. there's a couple bands of high clouds we have to go through. that's going to really keep the lid on us from warming too much. we'll inch highs upwards a little bit. low 60s, mid-60s coast and bay and upper 60s to looks like a few low 70s inland. warmer on the five-day forecast. we'll get to that soon. here's sal. steve, traffic is okay here at the bay bridge toll plaza. you will see that traffic is going to be okay coming in to san francisco. we are getting word of a new injury accident on the peninsula. i'm just trying to pull it up on the maps. there it is i have it up fellas if you want to put it up. an accident blocking two lanes northbound 101 near the redwood shores area two right lanes blocked with this injury crash. and traffic is going to be effected very soon. so if you're driving up let's say from palo alto up to san mateo just give yourself plenty of time. we will watch this for you have it for you in a few minutes.

at 5:31 back to the desk. okay, sal, thank you. time now 5:31. rain may have stopped but wet ground causing a lot of problems all over the bay area. ktvu's jade hernandez is in morgan hill now where mud slides have closed the roads leading to and from a small community. what's going on, jade? [ audio problems ] >> reporter: we actually can't show you the mud slide, but this is what we can show you this morning. there are barricades set up. they say road closed. just beyond them a small bulldozer. at the end of this road county park. we think we're about a mile and a half out. the slide happened saturday night or early sunday morning. santa clara county road department received a report about the mud slide sunday morning around 8:00. authorities say the community is trapped since the road is inaccessible to visitors. a resident told the morgan hill times that it covered about 40

to 50 feet of the road and about 100 residents in the community were cut off trapped in or out. we understand no one was hurt and no significant property damage. we just spoke to a guy delivering newspapers this morning. he told us he lives in morgan hill and knew about the mud slide which at the end of this road happened at cory road. >> i went to work this morning and my boss told me -- i told him that the road was closed yesterday. and he told me that at least half of it should be today. so i came to check it out. here i am, here you are. [ laughter ] >> reporter: we're back out live this morning, again, as we mentioned we haven't been able to get to the mud slide because of the barricades that have been set up on the road just about a mile and a half out is exactly where this mud slide is. pg&e has been out here. the trees that fell over this weekend took out some power lines. we understand that there's still about 150 people trapped in or out due to the mud slide

over the weekend. we are reporting live from morgan hill this morning, jade hernandez, ktvu channel 2 news. all right. time now 5:33. the santa cruz county board of supervisors holds an emergency meeting tonight. this is in response to a week of devastating -- look at these pictures. rain, flooding and mud slides all across that county. the board will vote on declaring a local state of emergency. they'll ask for financial help from the state and the federal government. the long list of storm problems includes disastrous flooding and big mud slide in scotts valley. in san pablo the city's board of supervisors will also vote today on a state of emergency proclamation. that vote comes after a landslide last friday. that landslide has left three homes yellow tagged, three others are at risk. they're also working on setting up a fund to help out those homeowners that have been

effected. another key witness takes the stand today in the barry bonds perjury trial. ktvu's allie rasmus tells us it's a manuel-known to bay area baseball fans. >> reporter: not just one man, but two men that may be well- known to bay area baseball fans. we're talking about jason and jeremy giambi. both brothers played for the oakland a's at one point and today they're expected to be called to the stand the first of several pro-athletes called to testify in the barry bonds perjury trial. both brothers have admitted in the past to using performance enhancing drugs. their testimony today isn't going to focus on barry bonds specifically or what they may or may not have seen him doing. instead the two brothers are expected to talk about their working relationship with greg anderson. anderson was bonds' trainer and he is the man accused of giving bonds steroids. both brothers have said in the past that they specifically sought out anderson because of bonds' success. the message prosecutors are

trying to send to the jury with the giambi testimony bonds had to know the stuff he was getting from his trainer contained steroids because it was common knowledge they'll say among other baseball players and barry bonds peers. bond is on trial because he's accused of lying to a grand jury about his steroid use. barry bonds is expected to be in court again today just like he has every day since his trial started last week. things get going around 8:30. before the brothers are called to testify, san, the the former giants athletic trainer will be up on the stand first. he's also expected to talk about greg anderson and his working relationship with barry bonds. it all gets started around 8:30 this morning. live in san francisco, allie rasmus, ktvu channel 2 news. thank you, allie. you can also get updates on the bonds case any time by going to our channel 2 website at ktvu.com. just go right to our home page. this morning a ten year legal battle involving wal-mart and women makes it to the

supreme court. arguments begin today in the sex discrimination lawsuit that involves the retailer and whether the case should be given class action status. now stay with us here on the ktvu morning news because coming up in just about ten minutes we're going to go live to washington d.c. for more on today's hearing. well, the testimony continues this morning in the chauncey bailey murder trial. the confessed killer will be on the witness stand again today. at yesterday's hearing he testified that bay ordered him to kill the oakland journalist. he also says bay ordered him to kill another man out of revenge. on the stand yesterday he started laughing as he described that man trying to run away when he saw him level his assault rifle. time now 5:37. a jury convicted a san mateo teenager on five of seven felony counts. today they're going to resume deliberations on the remaining two. alexander detonated two pipe

bombs at the high school back in august of 2009. the jury found him guilty on five counts including the attempted murder of his former chemistry teacher. the jury deadlocked on the other two counts. a second phase of the trial still has to be held to determine his sanity. a professional poker player could spend the rest of his life in prison after a jury found him guilty of two counts of first-degree murder for killing his parents. prosecutors argue that he killed his parents three years ago because he was in debt and wanted inheritance. his ex-wife, sister all testified against him. he'll be sentenced. a turf war in san jose. and the san jose sharks are caught right in the middle. gang members are wearing sharks colors and jerseys showing their allegiance to the city and claim it is their own. then with the sharks making another run at the stanley cup,

more people are beginning to wear the team logos. police say it's the behavior that triggers violence. >> wearing the jersey itself that's tough to say. it's the lifestyle really that's going to get some of these gang members in trouble with physical violence. >> now some of the sharks fans we talked to didn't know about that connection between the hockey team logo and gangs. they say they haven't run into any problems yet and they'll continue to support their team. the schools are considering banning students from wearing sharks jerseys and hats. 5:39 is the time right now. let's go back to sal to check in on traffic. sal, how does it look? there's a crash now on the peninsula northbound 101. this time near the redwood shores exit. traffic is going to be starting to back up in that area because two lanes are blocked. also we have a look at 880 southbound at 238. two lanes of that ramp are closed because of a big rig

crash that they're trying to clean up. one lane is open. so cars are still getting by, but it may be a bit of a slow down. let's go out and take a look now at the east shore freeway westbound 80 traffic looks okay getting out to the macarthur maze. this morning's commute at the bay bridge toll plaza is still light. now let's go to steve. sal, thank you. yesterday's weather lots of happy faces, temperatures not that warm but at least it was sunny out. mostly sunny. and today will be about the same. a few high clouds. yesterday we had some patchy low clouds. today they'll be higher clouds. but 40 to 50 to start off. and then a combination of sun and clouds. 56 to 64 by noon. if you can get that sun it's not too bad. and then mostly sunny 60 to 70 as when he had towards this afternoon. if you're heading out to the coliseum tonight, giants and a's looks good to me. mostly clear. nice inside. little breezy outside. but game time temperature at 56 degrees. downtown oakland looking for a high today of 64. we'll start off at 47. go 54 at noon and then 64 on

safety after the san bruno explosion. it's a well-known case involving wal-mart and women. the supreme court will hear arguments today. it involves whether or not this case could become even bigger. reporter in washington d.c. with what's at stake in this ongoing legal battle. >> reporter: this is such a significant case it could set a huge precedent and could affect a million and a half wal-mart workers. this of course is very significant for wal-mart too. they are watching this case very closely. there's a lot of money on the line for the retail giant. you may recall that this started with a group of female employees, they claimed they were paid less than their male counterparts and were repeatedly passed over for promotions. the women are seeking a class action for all wal-mart workers and that's where the supreme court comes in. so justices will not be deciding the merits of their case, just whether they can bring a class action lawsuit. and if they can the results could end up costing wal-mart

in prison, 43-year-old maurice caldwell wakes up a free man this morning. yesterday at 5:00 p.m. mr. caldwell there was released from the san francisco county jail after a judge overturned his murder conviction. mr. caldwell was convicted of a second-degree murder for the shooting death back in june of 1990. now after two decades in jail, a nevada prison inmate confessed to the crime and more witnesses have come forward. >> been a long journey. i mean all these years i knew my brother was innocent of the charges. >> mr. caldwell says he feels bad for the family but he's happy his name has finally been cleared. he says after more than two decades in prison he can't wait to begin his life over. prosecutors in the case were hoping for a retrial, now they say they're considering an appeal. 5:49 is the time right now. back over to sal to check in on traffic. couple of crashes you've been talking about. that's right. one of them i just want to

welcome back to the morning news. federal officials are now trying to figure out what caused a hole in the side of a u.s. airways jet. a pilot discovered the hole during a mandatory pre-flight inspection. now the plane had flown to charlotte, north carolina, from philadelphia earlier in the day. there were no problems reported in that flight, but the plane was taken out of service and passengers rebooked on other flights. new information about the newspaper bomb that seriously injured a man in vacaville. sunday's explosion left its
